Avoiding Common FLSA Classification Pitfalls - Available at Multiple LocationsMarch 16, 2015

The most common wage and hour suits are based on the argument that an employee or group of employees is misclassified as exempt. These claims are expensive to defend, and can result in substantial liability in the form of unpaid overtime for up to three years, liquidated damages, and attorneys' fees.

In this seminar, Join McNair attorneys as they present Avoiding Common FLSA Classification Pitfalls, as they review the FLSA exemption categories, focusing on areas where employers often make mistakes. The discussion will include:

  • Requirements of the Executive, Administrative, Professional, Computer, and Outside Sales exemptions;
  • How to ensure that exempt employees are paid on a "salary basis" or "fee basis", as required by the FLSA;
  • When you can and cannot take deductions from employees' salaries;
  • How to ensure your PTO/paid leave program complies with the FLSA's requirements; and
  • The future of the FLSA in light of President Obama's directive to DOL to revise the exemption regulations.
