Overview

Stacy represents clients in the often complex legal matters surrounding the environmental, energy and natural resources arenas. Stacy also possesses a background rooted in the sciences, which equips him to understand the science and technical issues underlying the legal requirements. Drawing upon this background, he can better help clients develop compliance solutions that reflect the regulatory and scientific realities of the situation, while also recognizing the client’s business and operational needs.

Stacy serves as counsel in regulatory and transactional matters; property acquisition and development, including brownfields development; complex enforcement actions by state and federal agencies; permitting and permit appeals; NEPA compliance; environmental remediation and cleanup; litigation over environmental cleanup costs and toxic tort claims; and the regulation of energy production, including renewable energy projects. Recognizing that compliance is generally the best “defense,” Stacy also has substantial experience helping guide clients through internal compliance audits and facility reviews. 

In addition to environmental matters, he assists clients with Occupational Safety and Health Administration (OSHA) issues, particularly those related to hazardous substances, as well as defending clients in OSHA investigations.

  • Advise national and international clients through multimillion dollar remedial efforts under RCRA and CERCLA, large real estate and corporate transactions, and environmental compliance issues upon which continued operations hinge.
  • Represent clients in complex cost recovery litigation related to environmental contamination.
  • Represent private and public entities in the NEPA review and compliance process and in defense of determinations.
  • Draft and submit comments by major industry groups and private business in response to proposed environmental rulemaking at both the federal and state levels.
  • Assist large scale development projects and related property acquisitions in matters of land use management, including the incorporation of endangered species management, wetland preservation, and other land use restrictions into economic land use management decisions.
  • Represent clients (including assisting the client in working with local governments) in the siting or expansion of community-sensitive projects, such as projects related to waste management and disposal.
  • Represent clients in exposure claims and litigation related to alleged off-site sources, as well as on-site sources and indoor air quality.
  • Assist energy clients in the myriad of environmental regulations affecting energy production, including the development and operation of renewable energy projects.
  • Assist clients in OSHA compliance and in OSHA investigations, particularly as it relates to hazardous materials or radiation.
  • Represent clients in permitting, citizen suits, and enforcement actions under the full array of state and federal environmental programs, including:
    • Clean Air Act
    • Clean Water Act
    • Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
    • Emergency Planning and Community Right to Know Act (EPCRA)
    • Endangered Species Act
    • Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)
    • National Environmental Policy Act (NEPA)
    • Oil Pollution Act
    • Resource Conservation and Recovery Act (RCRA)
    • Toxic Substances Control Act (TSCA)
